Our Mozaic provides community hosting and data processing services. We help communities manage their data across various platforms, making it easier to organize, search, and utilize community content according to community-defined guidelines.

3. Content Rights and Licensing

Your Rights

You retain ownership of all content you share through our Services. Our Mozaic does not claim ownership of any information or content you submit to our platform. You simply grant us a license to process this content as described below.

Our Rights

Our Mozaic owns all copyrights, trademarks, domains, logos, and intellectual property associated with our Services. You may not use our intellectual property without our express permission.

Your License to Our Mozaic

When you use our Services, you grant Our Mozaic a license to process the content you share according to your community guidelines. This license allows us to store, display, organize, transform, and process your content solely for the purpose of providing our Services to you and your community. This license is limited to what is necessary to operate our Services as authorized by your community.

Our License to You

We grant you a limited, non-exclusive license to use our Services according to these Terms and your community's guidelines. This license is for your personal use of our Services in the manner described in these Terms. No other rights are granted except those explicitly stated here.

Third-Party Platform Compliance

Our Services may interact with various messaging and communication platforms. You acknowledge that:

  1. We are not affiliated with or endorsed by any third-party messaging platforms
  2. You remain responsible for ensuring your use of our Services complies with the terms of service of any third-party messaging platforms you use
  3. We process content according to your instructions and community guidelines, but you must ensure these instructions do not violate third-party platform terms
  4. Content shared through third-party platforms remains subject to those platforms' terms and policies

4. Content Processing and Community Guidelines

Our Services process content according to community guidelines established by community administrators. We only process content from communities and members who have explicitly chosen to use our Services. Community members consent to processing through their participation in communities that have selected our Services.

Communities maintain full control over how their content is processed. They establish guidelines for data handling, retention, and sharing. Our processing activities follow these community-defined parameters. Community administrators are responsible for ensuring all members understand and consent to these guidelines.

Community Membership and Consent

Our Services are designed for communicating with individuals who have explicitly:

  • Opted into your community
  • Expressed interest in joining your community
  • Provided consent to receive communications
  • Voluntarily shared their contact information

As a community administrator, you represent and warrant that you are using our Services only to communicate with individuals who have actively chosen to engage with your community. Our platform is not designed for cold outreach or unsolicited communications, and you agree not to use it for such purposes.

You acknowledge that using our Services to send unsolicited messages may violate third-party platform terms and applicable laws. You bear sole responsibility for ensuring your community engagement practices comply with messaging platform terms and relevant anti-spam regulations.

5. Appropriate Use and Content Restrictions

Content Standards

Our Services must not be used to store or process content that is illegal, harmful, abusive, or violates the rights of others. We prohibit content that promotes violence, discrimination, harassment, or any illegal activities. Community administrators are responsible for monitoring content within their communities.

Communication Standards

Our Services are designed exclusively for communication with individuals who have explicitly opted into your community or have shown interest in joining. You must not use our Services to:

  • Send unsolicited messages or marketing communications
  • Contact individuals who have not expressly consented to join your community
  • Distribute promotional content to recipients who have not opted in
  • Circumvent opt-in requirements of messaging platforms
  • Engage in bulk messaging that violates messaging platform terms

You acknowledge that messaging platforms have specific terms regarding acceptable communication practices, and you remain solely responsible for complying with these terms when using our Services.

Content Removals

We will remove harmful or illegal content upon discovery or notification. Community administrators may request content removal at any time. Individual members may request removal of their own content. We will process these requests promptly according to applicable laws and community guidelines.

Prohibited Activities

Users must not:

  • Attempt to gain unauthorized access to our Services or systems
  • Transmit malicious code or attempt to harm our Services
  • Collect user information without proper authorization
  • Use automated means to access or use our Services except as expressly permitted
  • Create derivative works or competing services based on our intellectual property
  • Engage in any activity that disrupts or interferes with our Services
  • Violate the terms of service of any third-party platform integrated with our Services
  • Use our Services in ways that could lead to account restrictions on messaging platforms

6. Data Protection and Privacy

We process all data in compliance with the General Data Protection Regulation (GDPR) and other applicable data protection laws. We implement appropriate security measures to protect community data according to industry standards and community requirements.

As a data processor, we only process data according to community instructions. We assist communities in fulfilling their data protection obligations and responding to data subject requests. We maintain appropriate records of processing activities as required by law.

7. Community Responsibilities

Community administrators using our Services are responsible for:

  • Obtaining necessary consents from their members
  • Creating clear community guidelines for data processing
  • Ensuring compliance with applicable data protection laws
  • Managing member data rights requests
  • Monitoring content for compliance with content standards
  • Notifying us of any data protection concerns

8. Limitation of Liability

Our Services are provided "as is" without warranties of any kind. To the extent permitted by law, we shall not be liable for indirect, consequential, or incidental damages related to your use of our Services. Our total liability for any claims will not exceed the amount you have paid us in the previous 12 months.

9. Service Changes and Termination

We may modify or discontinue any part of our Services with reasonable notice. You may terminate your use of our Services at any time. We may suspend or terminate access for violations of these Terms or community guidelines, or for extended periods of inactivity.

10. Governing Law

These Terms shall be governed by the laws of Portugal. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Portugal.
